These Terms of Service ("Terms") govern your use of our website, facilities, memberships, bookings, classes, products and services. By accessing our website, purchasing products, booking sessions, becoming a member or using any Zone 5 services, you agree to be bound by these Terms.

These Terms apply whether you interact with Zone 5 through our website, Shopify, ClubRight, in person or through any other platform we use to provide our services.

If you do not agree to these Terms, you should not use our services.

3. Definitions

For the purposes of these Terms:

Member means any individual holding an active or inactive membership with Zone 5.

Membership means any membership, subscription, pass or access package offered by Zone 5.

Facility means any premises operated by Zone 5 Leicester Ltd.

Website means the Zone 5 website and online store.

Booking means any reservation for a class, event, consultation, personal training session or other service.

ClubRight means our membership management and booking platform.

Shopify means our online ecommerce platform.

4. Eligibility

You confirm that:

all information you provide is accurate;
you are legally capable of entering into a contract;
you will comply with these Terms.

Where members are under 18 years of age, parental or guardian consent may be required.

Zone 5 reserves the right to refuse or terminate membership where appropriate.

5. Memberships

Zone 5 may offer various membership options from time to time.

These may include, but are not limited to:

Rolling monthly memberships
Fixed-term memberships
Prepaid memberships
Promotional memberships
Student memberships
Corporate memberships
One-off sessions
Day passes
Trial memberships
Class packages
Event tickets
Guest passes
Personal training packages
Online coaching
Hybrid coaching
Any future membership or access product introduced by Zone 5.

Membership benefits, pricing and availability may vary.

6. Membership Payments

Membership fees must be paid in accordance with the selected membership.

Payments may be collected through:

Direct Debit
Debit card
Credit card
Shopify Payments
Stripe
GoCardless
ClubRight
Any other payment provider used by Zone 5.

By purchasing a membership, you authorise Zone 5 to collect payments due under your agreement.

Failure to make payment may result in suspension or termination of access.

7. Direct Debit Memberships

Where memberships are paid by Direct Debit:

payments will be collected on the agreed collection date;
you are responsible for ensuring sufficient funds are available;
missed payments remain payable;
administration charges may apply where permitted by law;
repeated payment failures may result in suspension or cancellation.

Zone 5 reserves the right to appoint a third-party payment provider to administer Direct Debits.

8. Rolling Memberships

Rolling memberships continue until cancelled in accordance with these Terms.

Members remain responsible for all payments due until cancellation becomes effective.

Membership fees may change upon reasonable notice.

9. Fixed-Term Memberships

Fixed-term memberships remain active for the agreed period.

Unless expressly stated otherwise:

fixed memberships are non-refundable;
they do not automatically renew unless agreed;
they cannot be transferred.

10. One-Off Sessions

Zone 5 may offer:

drop-in sessions;
open gym sessions;
personal training;
classes;
consultations;
workshops;
events.

Booking confirmation does not guarantee availability if payment has not been received.

11. Bookings

Bookings may be made using ClubRight, our website or any approved booking platform.

Members are responsible for attending booked sessions on time.

Late arrival may result in refusal of entry where it would disrupt the session.

Zone 5 reserves the right to cancel or reschedule sessions where necessary.

12. Cancellations

Cancellation periods may differ depending on the service booked.

Failure to attend a booked session without appropriate notice may result in loss of the booking or applicable charges.

13. Membership Changes

Zone 5 may allow members to:

upgrade memberships;
downgrade memberships;
transfer membership types;
renew memberships;
purchase additional services.

Requests are subject to approval and may take effect from the next billing period unless otherwise agreed.

14. Membership Freezes

Where offered, memberships may be frozen at Zone 5's discretion.

Conditions, minimum periods and administration fees may apply.

Medical evidence may be requested where appropriate.

15. Prices

Prices may change at any time.

Existing members will receive reasonable notice before any recurring membership fee changes take effect.

Promotional pricing is temporary unless expressly stated otherwise.

16. Promotions

Discount codes, promotional offers and introductory memberships:

cannot usually be combined;
may be withdrawn at any time;
have no cash value;
may be subject to additional conditions.

17. Refunds

Refunds are governed by our Refund Policy and applicable UK consumer law.

Nothing in these Terms limits your statutory consumer rights.

18. Health Declaration

Members confirm that they are physically capable of participating in exercise unless advised otherwise by a qualified medical professional.

Members agree to inform Zone 5 of any relevant medical condition that may affect safe participation.

Participation is undertaken at the member's own risk.

19. Assumption of Risk

Exercise carries inherent risks including, but not limited to:

falls;
equipment failure;
muscle strains;
sprains;
illness;
serious injury.

By using our facilities or services, you acknowledge these inherent risks and agree to exercise responsibly and follow all instructions provided by Zone 5 staff.

20. Member Conduct

Members must:

behave respectfully;
follow staff instructions;
use equipment correctly;
maintain appropriate hygiene;
wear suitable clothing and footwear;
avoid behaviour that places others at risk.

Zone 5 may suspend or terminate memberships where conduct is unacceptable.

21. Personal Property

Members are responsible for their own belongings.

To the fullest extent permitted by law, Zone 5 accepts no responsibility for loss, theft or damage to personal property unless caused by our negligence.

22. CCTV

CCTV may operate throughout our premises for safety, security, safeguarding and crime prevention.

Recorded footage may be disclosed where legally required.

23. Photography & Media

Zone 5 may occasionally capture photographs or videos for promotional purposes.

Where an individual is clearly identifiable, we will seek appropriate permission where required by law.

Members may request not to appear in promotional material by contacting us.

24. Website Use

Users must not misuse the website, interfere with its operation or attempt unauthorised access.

All content, branding, logos, graphics and intellectual property remain the property of Zone 5 Leicester Ltd unless otherwise stated.

25. Third-Party Services

We may use third-party providers including, but not limited to:

Shopify
ClubRight
Payment processors
Marketing providers
Email providers
Analytics providers

Their services may also be subject to their own terms and privacy policies.

26. Suspension & Termination

Zone 5 may suspend or terminate memberships or access where:

payments remain outstanding;
these Terms are breached;
member behaviour is unsafe or abusive;
fraudulent activity is suspected;
continued access would pose a safety or security risk.

27. Limitation of Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation or any other liability that cannot lawfully be excluded under the laws of England and Wales.

Subject to the above, Zone 5 shall not be liable for any indirect or consequential loss arising from the use of our facilities or services.

28. Force Majeure

Zone 5 shall not be responsible for delays or failure to perform obligations where such failure results from events beyond our reasonable control, including but not limited to severe weather, utility failures, industrial disputes, pandemics, government restrictions or other unforeseen events.

29. Changes to These Terms

We may amend these Terms from time to time.

The latest version will always be published on our website.

Continued use of our services following publication of updated Terms constitutes acceptance of those changes.

30. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
